The protection of your personal data is a central concern for us. This privacy policy informs you about what personal data we collect, for what purpose we use it, to whom we disclose it, and what rights you have. It applies to all data processing in connection with the online shop www.lyvity.com.

This privacy policy complies with the requirements of the revised Swiss Data Protection Act (DPA), in force since September 1, 2023.

2. What Data We Collect and Why

2.1 Orders and Contract Fulfillment

When you place an order with us, we collect the following data to fulfill the contract: first and last name, shipping and billing address, email address and phone number, order details (products, quantities, prices), and payment information (processed via our payment service providers; we do not store complete payment data).

Legal Basis: Contract fulfillment (Art. 31 DPA). Without this data, we cannot process your order.

2.2 Customer Account

If you create a customer account, we additionally store your order history and your preferred settings to facilitate future orders.

2.3 Customer Support and Communication

If you contact us via email, contact form, or phone, we process your request and all personal data contained therein to be able to respond to you.

2.4 Newsletter and Marketing

If you subscribe to our newsletter, we use your email address to send you product information, offers, and news. Legal Basis: Consent. You can unsubscribe from the newsletter at any time via the unsubscribe link in each email or by emailing info@lyvity.com. For newsletter distribution, we use Klaviyo, which processes the data on our behalf.

2.5 Website Usage, Cookies, and Analytics

When you visit our website, technical data is automatically collected (IP address, browser and device type, pages visited, date and time, referring URL). This data is collected through cookies and similar technologies. We differentiate between technically necessary cookies and optional analytics and marketing cookies. For optional cookies, we obtain your consent via our cookie banner.

2.6 Shopify as Shop Platform

Our online shop is operated on the Shopify Inc. platform (Canada). Shopify processes your order and payment data as a data processor on our behalf. Further information: www.shopify.com/legal/privacy.

2.7 Payment Processing

Payments are processed via external payment service providers (e.g., Stripe, PayPal, Klarna, or similar), depending on the chosen payment method. These providers process your payment data independently according to their own data protection policies. Lyvity only receives confirmation of whether the payment was successful.

2.8 Shipping Service Providers

To deliver your order, we pass on your shipping address and name to our shipping partners (e.g., Swiss Post, DHL, DPD, or similar). This data is used exclusively for the purpose of delivery.

3. Disclosure of Data to Third Parties

We only disclose your personal data to: data processors acting on our behalf (e.g., Shopify, shipping service providers, newsletter providers); independent payment service providers; and authorities, if we are legally obliged to do so or to defend legal claims. Data will not be disclosed to third parties for advertising purposes without your consent.

4. Data Transfer Abroad

Some of our service providers (especially Shopify Inc., based in Canada, and payment providers with servers in the USA or other countries) process data outside of Switzerland. For transfers to countries without an adequate level of data protection, we ensure that your data is adequately protected through appropriate safeguards (e.g., standard contractual clauses).

5. Storage Duration

  • Order data and invoices: 10 years (statutory retention period according to OR)
  • Customer account: until deletion by the customer, maximum 5 years after last activity
  • Newsletter data: until unsubscribe
  • Support inquiries: 3 years after completion
  • Website analytics data: typically 13–26 months

6. Your Rights

The Swiss Data Protection Act grants you the following rights: access, rectification, deletion, restriction of processing, data portability, objection, and withdrawal of granted consents. To exercise your rights, please contact us by email at info@lyvity.com, stating your identity. We will process your request within 30 days. If you believe your data protection rights have been violated, you can lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC): www.edoeb.admin.ch.

7. Data Security

Lyvity takes appropriate technical and organizational measures to protect your personal data from unauthorized access, loss, misuse, or alteration, including encrypted data transmission via SSL/TLS, access restrictions to authorized employees, and regular review of security measures.

Our website uses cookies. We distinguish between technically necessary cookies (essential for the operation of the shop, e.g., shopping cart, login session), analytics cookies (only with your consent), and marketing cookies (only with your consent).
